Definitions
  • 1.1 “ACCESS BANK” means Access Bank Plc
  • 1.2 "REAL” means the rewards program established by the Bank and subject to these Terms and Conditions.
  • 1.3 "REAL Account" means the account reflecting all transactions relating to REAL for a particular REAL Accountholder in ACCESS BANK’s records, including earned REAL Points, bonus REAL Points, redeemed REAL Points and expired REAL Points.
  • 1.4 "REAL Accountholder" means, in relation to each REAL Relationship, the customer or, where there is more than one person comprising the customer, the first named signatory holding such relationship.
  • 1.5 "REAL Booking Policy" means the booking policy to redeem REAL Points as published from time to time on the REAL Website.
  • 1.6 "REAL Points" means the reward points credited/debited to the REAL Account as a result of any REAL Relationship or REAL Transaction.

    REAL Reward Relationship means any customer who has activated his membership for the purpose of receiving Points.

    POINTS: means the reward value accrued from every transaction conducted by a customer as specified in the POINT Matrix and it is valued at 0.50k per point

    POINTS MATRIX: means the REAL Point Accrual Matrix as set out in Schedule B as may be amended in ACCESS BANK’s sole discretion from time to time. REAL Transaction means the particular transactions that qualifies for Point Accrual. The transactions are specified in the Point Accrual Matrix.

    REAL Statement is the account statement of the customer on the Loyalty Website showing the numbers and category of Points earned or redeemed by the customer.

  • 1.7 "REAL Statement" has the meaning set out in Clause 5.1.
Binding Effect

The following terms and conditions ("Terms and Conditions") are applicable to REAL and, by becoming a REAL Accountholder, you agree to be bound by the Terms and Conditions, as the same may be amended, supplemented, updated, replaced or otherwise varied by the Bank from time to time and by signing this form you represent and warrant that you are aged at least 18 years.

  • 2.1 All determinations to be made under REAL shall be made by the Bank, at its absolute discretion and on the basis of its Records, and each such determination shall be final, conclusive and binding on the REAL REWARDS Accountholder, save in the absence of manifest error made known to the Bank by the REAL Accountholder in accordance with the time limit set out in Clause 5.2.
    • 2.1.1 The Bank reserves the right, at any time, at its absolute discretion, without notice and without liability whatsoever on its part, to supplement, amend, replace, delete or otherwise vary any of the Terms and Conditions, including the Schedules, as well as the terms and conditions of any other policy referred to in the Terms and Conditions, and to change, vary, modify, terminate or cancel REAL or any of its benefits or features, or otherwise do any other act with respect to the whole or any part of REAL, or to withdraw or change the membership criteria and/or to limit or change the value / validity of REAL and/or the manner of redemption on, REAL. By becoming a REAL REWARDS Accountholder, you acknowledge and accept that the mentioned foregoing acts may diminish or result in a loss of the redemption value of REAL Points already earned and agree you shall not be entitled to claim compensation for any such loss in value.
    • 2.1.2 By becoming a REAL Accountholder, you acknowledge and agree that the Terms and Conditions, as well as other information regarding REAL, are published and may be accessed online at, and you acknowledge and agree to keep yourself updated with the most up to date and current version.
  • 2.2 In addition to these Terms and Conditions, each REAL Accountholder continues to be subject to the General Terms and Conditions of Account Opening and the terms and conditions applicable to the relevant ACCESS BANK product which made him/her eligible for participation in REAL, including without limitation, personal loan, car loan, mortgage loan, investment products, credit card, debit card, current account, savings account, fixed deposit, electronic transaction channels and such other terms and conditions as may be included by the Bank from time to time, which are incorporated by reference herein and copies of which shall be provided to the REAL Accountholder upon request.
Membership

Membership in REAL is automatic for each ACCESS BANK customer holding a REAL Relationship and who is in good standing and otherwise not in breach of any terms and conditions relating to such REAL Relationship. However, customers must activate their membership to be able to view their loyalty points.

  • 3.1 The REAL membership is limited to the primary (i.e. first named) customer accountholder. Membership qualifies the ACCESS BANK Accountholder to benefit from special offers and promotions which may be provided by the Bank from time to time, provided the REAL Relationship is in good standing and provided there has been satisfactory conduct of the customer’s account).
  • 3.2 Membership is also subject to the qualifications and conditions (including annual REAL Points accrual limits, if any) as determined by the Bank. The Bank reserves the right, at any time and without notice, to impose a validity period on membership, as well as to extend or reduce the same.
  • 3.3 Membership on REAL is non-transferable.
  • 3.4 In the case of joint or multiple holders of a REAL Relationship, all authorized signatories will be automatically enrolled on REAL. However, the use and redemption of REAL Points shall only be available to the primary (i.e. first named) REAL Relationship signatory as per the Bank’s Records and is limited as described in the Terms and Conditions. However, each REAL

    Accountholder will accrue REAL Points with respect to his or her related accounts or services to be credited to the REAL Account. Each REAL Account is identified by the Customer Identification (CIF) Number of the primary (i.e. first name) REAL Reward Relationship signatory as established by the Bank’s Records.

  • 3.5 In the event that a customer account signatory (ies) or a supplementary cardholder(s) is/are removed from the relevant REAL Relationship, then such signatory (ies) or supplementary cardholder(s) is/are no longer eligible to participate in REAL.
  • 3.6 The Bank reserves the right, at any time, at its absolute discretion, without notice and without liability whatsoever on its part, to withdraw or discontinue any one or more of the REAL Relationships or REAL Transactions and terminate membership on REAL and revoke any accrued REAL Points.
  • 3.7 Membership on REAL is automatically terminated upon the death, bankruptcy, or unsatisfactory conduct of the account or relationship of the primary (i.e. first named) REAL Relationship holder.
  • 3.8 Upon termination of membership, all REAL Points accrued in the REAL Account shall be immediately forfeited and cancelled by ACCESS BANK. ACCESS BANK may also delete the terminated REAL Account on the REAL Website.
REAL Points
  • 4.1 ACCESS BANK shall determine, from time to time, at its absolute discretion, which REAL Relationships (including, without limitation, personal loan, car loan, investment products, banc assurance, current / savings account, fixed deposit, debit card or credit card, mortgage loan and electronic channels), and which ACCESS BANK debit card and credit card transactions (each a “REAL Transaction”) are eligible for inclusion in REAL and how many REAL Points each will earn, the associated limits on earnings as well as the number of REAL Points required for redemption of REAL. In case of a reversal of any REAL Transaction, REAL Points credited to the REAL Account as a result of such REAL Transaction will be deducted from the accrued REAL Points credit balance. Debits to the REAL Account unrelated to any reversed REAL Transaction will reduce the accrued REAL credit balance as per the calculation criteria set out for a particular REAL Relationship. No REAL Points may be earned during a promotion, special offer or other black-out period or through the redemption of any REAL Points as determined by ACCESS BANK from time to time and at its absolute discretion.
  • 4.2 Pursuant to Clause 4.1, REAL Points are earned for each of the REAL Relationship or REAL Transactions subject to REAL earning criteria, and no REAL Points shall be awarded retroactively. Schedule B sets out the list of further conditions attached to the earning of REAL Points in relation to each type of REAL Relationship or REAL Transaction. REAL Points are calculated by rounding down the transaction value to the nearest integer.
  • 4.3 REAL Points are not assignable or otherwise transferable, and are not capable of being mortgaged, charged or pledged, nor can REAL Points of one REAL Relationship holder or REAL Transaction holder be combined with those of another.
  • 4.4 In the event of a change to the status of a REAL Relationship (such as an upgrade or downgrade), the future calculation of REAL Points shall be adjusted by the Bank accordingly.
  • 4.5 REAL Points are valid only for a period of three (3) years from the start of the month during which such REAL Points are earned. Provided always that unless used prior to the expiration date, REAL Points shall expire on such date. Upon expiration, unused REAL Points will be removed from the REAL Account as of the expiration date and cannot be re-credited. It is the REAL Rewards Relationship or REAL Transaction holder's responsibility to be aware of both the number of REAL Points outstanding in his account and their expiration date. This can be monitored at any time online on the REAL Website.
REAL Statement
  • 5.1 A record of REAL activity for each REAL Relationship will be mailed electronically or otherwise made electronically available in the form of an electronic or online statement (“REAL REWARDS Statement”) to the REAL Accountholder on a regular basis, the regularity to be determined by the Bank at its absolute discretion. REAL Points shall be transferred on a periodic basis as per the REAL Relationship or REAL Transaction activity into the REAL Account for the purpose of accruing REAL Points. All the REAL Points shall accrue and expire as described in these Terms and Conditions and any additional terms and conditions contained in the REAL Statement. A REAL Rewards Points holder may access a copy of his/her REAL Statement online on the REAL Website. 5.2 Any manifest error in the REAL Statement must be reported to the Bank within fourteen (14) days of the REAL Statement date.
Redemption of REAL Points.
  • 6.1 Provided that in the opinion of the Bank, the REAL Relationship is active and in good standing, and subject to the approval of the Bank , REAL Points may be redeemed
    • (i) in exchange for air tickets, hotel stays or other specific merchandise, as may be published from time to time on the REAL Website, if available for purchase,
    • (ii) vouchers for any of the items of merchandise mentioned in

      (i) above, or
      (ii) to off-set specified ACCESS BANK fees and/or charges, as determined by ACCESS BANK .

  • 6.2 Only REAL Points that are registered in and credited to the REAL Account, at the time of redemption, are eligible for redemption as determined conclusively by ACCESS BANK in accordance with the Bank’s Records and in the absence of manifest error.
  • 6.3 The redemption of REAL Points by each REAL Accountholder is effected by logging onto and using the REAL Website. Any instructions conveyed by the REAL Relationship holder will be governed by the terms and conditions of the respective mode of redemption. The Bank, at its absolute discretion, may act upon the instructions received through these modes of redemption.
  • 6.4 In the case of joint or multiple REAL Relationship holders, only the primary (i.e. first named) signatory is eligible to redeem REAL Points. Additional REAL Points, however, may be purchased for a non-refundable fee if made available and agreed by the Bank.
  • 6.5 In the case where REAL Points are subtracted from the REAL Account and it reduces or eliminates the accumulated REAL Points resulting in a negative REAL Account balance, The Bank may, at its absolute discretion, either suspend delivery of the REAL Reward or permit the delivery of the REAL and either debit the equivalent cash value of the negative balance or use any subsequently accrued REAL Points to offset the negative REAL Account balance until such balance has returned to zero or positive.
  • 6.6 REAL Points redemptions (each a "REAL ") are always subject to the Bank’s approval, the Bank’s terms and conditions for the relevant REAL Reward, the availability of the REAL at the time the redemption is requested, and any restrictions imposed by any supplier or issuer of the good or services the subject of the REAL . At any time and at its absolute discretion, the Bank may, without notice or liability, cancel the REAL order and substitute the REAL with another of comparable nature and value as determined by ACCESS BANK.
  • 6.7 Details of the REAL are set out on the REAL Website. Reasonable efforts have been made to ensure that the information contained in the REAL Catalogue for Goods and Services is accurate. The Bank is not responsible, and shall not be held responsible, for any errors, inaccuracies or omissions appearing therein.
  • 6.8 Redemption of air tickets, hotel stays, other merchandise and or the issue of vouchers for the same pick up the specified reward/s at / from the Bank -authorized merchants and are subject to the terms and conditions as may be prescribed by the issuer or supplier thereof from time to time.
  • 6.9 Once issued, redemption of air tickets, hotel stays, other merchandise and vouchers are not exchangeable, returnable, refundable, or redeemable for cash or credit, nor will they be replaced in the event of loss, damage or destruction. Once submitted, an order for a redemption of air tickets, hotel stays or other merchandise or a voucher cannot be cancelled, revoked, transferred or changed by the REAL Accountholder in any manner.
  • 6.10 Redemption of air tickets, hotel stays and other merchandise or the issue of vouchers for the same are sent to the REAL Accountholder’s email ID or billing address in the Bank’s Records. If the REAL Accountholder wishes to have them sent to a different e-mail ID or delivery address, the e-mail ID or delivery address contained in the REAL Accountholder’s account profile on the REAL Website must be updated prior to redeeming any REAL Points. The Bank will not be responsible for any redemption of air tickets, hotel stays or other merchandise or the issue of a voucher sent to the wrong e-mail ID or delivery address or returned as a result of the REAL Accountholder’s failure to update his/her account profile information on the REAL Website.
  • 6.11 Should the goods or services the subject of a REAL be received in a damaged or defective condition, the REAL Accountholder must notify the relevant supplier of such damage or defect within the stipulated number of days as mentioned in the purchase receipt. The Bank shall use its reasonable efforts to convey the REAL Accountholder’s complaint to the supplier and arrange, whenever possible, for an appropriate replacement of comparable nature and value as determined by ACCESS BANK. Notwithstanding the foregoing, ACCESS BANK shall not be held responsible in any manner whatsoever for damaged or defective goods or services which are the subject of a REAL Reward
Forfeiture of REAL Points

All REAL Points of a REAL Accountholder shall be forfeited and shall be cancelled immediately and no additional or unprocessed redemption requests of REAL Points shall accrue in the REAL Account in the following circumstances:

  • (a) the REAL Relationship has been closed or is not in good standing (as determined by the Bank at its absolute discretion);
  • (b) breach of any of these Terms and Conditions and/or any other terms and conditions expressly incorporated by reference in these Terms and Conditions; or
  • (c) any other event or circumstance exists, which, in the absolute discretion of the bank , should result in such forfeiture.
Indemnity
  • 8.1 The Bank shall not be liable for losses, damages, expenses, claims or any other liability whatsoever, whether direct, indirect, consequential, incidental, special or punitive, sustained by a REAL Accountholder as a result of or in connection with the availability, non-availability, maintenance or operation of the REAL Website, the redemption of REAL Points, the possession and/or use of a REAL, the provision of any good or service pursuant to the Real Rewards program or in any other way arising from membership in, or in connection with, REAL, nor shall the Bank be responsible or held liable for any amounts payable by a REAL Accountholder to any third party arising out of the purchase, supply, quality, installation, use or otherwise, of a REAL, or of any negligence, breach of statutory or other duty on the part of ACCESS BANK , any supplier, issuer, merchant and/or other person associated in any way, directly or indirectly, with REAL.

    Furthermore the Real rewards Accountholder hereby irrevocably and unconditionally indemnifies the Bank against all losses, claims and liability arising out of the Real Rewards Accountholder’s use of the goods or services under Real or arising out of or in connection with the breach by the real rewards Accountholder of any of the terms of this agreement or such other terms and conditions relating to Real as the Bank may make from time to time.

  • 8.2 The Bank makes no representation and provides no warranty whatsoever, expressed or implied, and undertakes and assumes no liability whatsoever, in respect of the quality of any goods or services the subject of a REAL Reward or their suitability or fitness for any use or purpose. All goods or services the subject of a REAL shall be accepted by the REAL Rewards Relationship holder at his/her own risk and peril.
  • 8.3 The Bank is not responsible for any disputes involving REAL or any other aspect of REAL between joint signatories or multiple persons holding the relevant REAL Relationship. Any personal liability arising out of the delivery or use of REAL is solely the responsibility of the REAL Accountholder and any other holders of the relevant REAL Relationship.
Breach of Terms and Conditions
  • In the event of a breach by a REAL Accountholder of these Terms and Conditions or of any applicable provisions in any terms and conditions incorporated by reference in these Terms and Conditions, or in the event of the failure on the part of a REAL REWARDS Accountholder to pay for any outstanding amounts due to the Bank within the prescribed time set by the Bank or for any other reason whatsoever, the Bank reserves the right, at its absolute discretion, to:
  • 9.1 terminate the REAL Accountholder’s membership on REAL and close his/her REAL Account;
  • 9.2 refuse to award any future REAL Points;
  • 9.3 withdraw any REAL Points earned; and/or
  • 9.4 refuse to permit the redemption of any REAL Points.
  • Such action by the Bank in respect of a REAL REWARDS Accountholder may result, in the Bank’s absolute discretion, in the forfeiture of all of the REAL REWARDS Accountholder’s REAL REWARDS Points and any REAL REWARDS purchased and unused.
Governing Law

These Terms and Conditions are governed by the laws of the Federal Republic of Nigeria

SCHEDULE A

REAL Relationship* Salary Accounts – where the monthly salary is NGN--- or more; Fixed Deposit; Debit Card or Credit Card issued by ACCESS BANK ; or

Any other banker customer relationship as determined by the BANK from time to time.

* The REAL Earning Table will be mailed electronically and/or published on the REAL Website, and may be amended, supplemented, updated, replaced or otherwise varied from time to time by ACCESS BANK , at its absolute discretion without prior notice. The REAL Earning Table sets out the specific terms and conditions relating to each REAL Relationship and each REAL Transaction and such table, terms and conditions shall be incorporated by reference in these Terms and Conditions.

SCHEDULE B:

For Debit Cards

No REAL Points shall be earned for debit card transactions on domestic ATM withdrawals and related to the following: (a) fees, charges and interest; (b) transactions that the Bank determines, in its absolute discretion, are disputed, erroneous, unauthorized, illegal and/or fraudulent; and (c) any other transactions that the Bank may include on this list from time to time.

For Credit Cards:

No REAL Points shall be earned for credit card transactions related to the following:

  • (a) fees, charges and interest;
  • (b) any payments or amounts deposited or credited to the card account
  • (c) transactions that the Bank determines, in its absolute discretion, are disputed, erroneous, unauthorized, illegal and/or fraudulent; and
  • (d) any other transactions that the Bank may include on this list from time to time.

For Payroll (on monthly salary transfer of NGN ----- or more):

REAL Points will be credited to the REAL Account upon receipt of monthly salary. The amount of the salary against which REAL Points can be earned will be at the absolute discretion of ACCESS BANK and may not include allowances, bonuses, reimbursements and other similar salary credits.

For Time Deposit:

REAL Points shall be earned and credited to the REAL Account as per conditions conveyed by ACCESS BANK from time to time, and only if such REAL Account remains active and in good standing during such period.
